In the Ledger Dispatch's July 22 article, "Is Jackson blighted enough for redevelopment?" City Attorney Andy Morris reportedly said, "The law has changed. ... Proposition 99 passed in June, so it is no longer possible to take property for private development. There is greater protection for property owners." That statement is untrue. In reality, Proposition 99 only protects owner-occupied residential properties if lived in for a year or more. Proposition 99 does not protect any other private properties such as residential rentals, commercial, manufacturing or churches. It was unfortunate that Andy must have only read the propaganda regarding Proposition 99 and not the actual initiative itself. Proposition 98 was the initiative that protected all types of private property from eminent domain by governments for private developments. Property owners should be aware of the difference!
