A Sutter Creek man who faces felony charges in Colusa County for cruelty to animals will be retried in December after the jury in his current trial resulted in a hung jury June 18, according to the Colusa County District Attorney's Office.
The jury voted 9-3 in favor of convicting John B. Allen Jr., which resulted in a hung jury because the vote was not unanimous, the district attorney's office stated.
The charges against Allen started after a neighbor of his noticed two neglected horses on Allen's property in Colusa County. One of the horses was taken into custody by the district attorney's office. The other horse had died before officials arrived, allegedly from dehydration and malnutrition.
"We're disappointed, but respect their decision and charges will be re-filed," said a representative from the Colusa County District Attorney's Office.
Allen runs a law practice in Jackson.
