Gun collector freed without posting $1.5 million bail (2:58 p.m.)

SAN ANDREAS -- A wealthy Calaveras County gun collector accused of trading machine guns across state lines was allowed to remain free Thursday after he claimed to have suffered a heart attack when he was briefly held in the Calaveras County Jail earlier in the week.

Dale Albert Buller, 79, of Glencoe was ordered by Judge Duane Martin not to have any guns in his possession, to submit to searches by law enforcement, and to show up for his court dates.

But Martin also allowed Buller to remain free without posting the $1,495,000 bail that had been set when Buller went to jail on Monday.

That decision ends an apparent tussle between the Calaveras County District Attorney and the Calaveras County Sheriff's Department over whether Buller should be in jail.
