DA files new case against former Ione prison guard

A new case has been filed against Danny James Akemon, the former Mule Creek State Prison guard already awaiting trial on charges of engaging in lewd and lascivious acts with a 14-year-old boy.

The new allegations were presented by the Amador County District Attorney's Office to superior court Judge David Richmond on Thursday, causing Akemon's pending trial to be delayed while his defense studies evidence in the emerging case.

Akemon was arrested a little over a year ago by the Amador County Sheriff's Office after Sgt. Mark Lawrence interviewed a then-14-year-old male who would come to be referred to in court proceedings as K.B. According to Lawrence's investigation, Akemon invited K.B., a "family friend," to stay overnight at his home on Camanche Parkway in June of 2007. The victim told Lawrence that, during the night, Akemon gave him several servings of hard alcohol, showed him pornography and then brought out lubricant and a sex toy.

During his testimony in Akemon's preliminary trial, Lawrence said that Akemon and the minor proceeded to engage in different sex acts, for which Akemon was eventually charged with six felony counts of lewd and lascivious conduct.

The prosecution of Akemon is being handled by Chief Deputy District Attorney Melinda Aiello. In addressing the new case she filed against Akemon Thursday morning, Aiello told the Ledger Dispatch that the conduct in question stemmed from the same period the original charges were filed over. "He was arraigned on a new case that has to do with some things the victim had not originally discussed," explained Aiello.

This was not the first time that K.B. had experienced trouble speaking about the extent of his alleged sexual activity with Akemon. According to court documents, K.B. initially told investigators that he did not engage in oral copulation with Akemon. He later admitted he had. During the preliminary trial, Lawrence was asked why K.B. had changed his story.

"He was very embarrassed by it," Lawrence replied.

Akemon's next court appearance is scheduled for April 2. Aiello said a preliminary hearing on her new case against Akemon will likely be set then, causing the current case to be "trailed behind it." What Aiello is ultimately hoping for is consolidation of all the charges.

"I'm basically hoping we can get the new case combined with the old case as we move ahead," she said.

Akemon worked at the Ione prison from June 2007 to March 2008. At least one prison inmate has contacted the Ledger Dispatch with allegations that Akemon had "grown up sexual relations" with an inmate imprisoned there. Mule Creek launched its own internal investigation into Akemon's tenure as an employee, the results of which are unknown at this time.
